Add a Collective Bargaining Agreement

Overview

A Collective Bargaining Agreement (CBA) establishes wage rates, fringe benefits, and overtime requirements, as well as other employment terms and conditions for union employees.

For applicable state prevailing wage work, an approved CBA allows eComply to use the CBA's base wage and fringe benefit amounts when checking Certified Payroll Reports (CPRs). This helps the system evaluate wage and overtime compliance without requiring agencies to manually compare the CBA with payroll each week.

CBA rates apply to state requirements only. They do not replace federal wage requirements. When a project is subject to both state and federal requirements, eComply compares the applicable requirements and uses the stricter requirement when checking the employee's paid rate.

The approved CBA rates can be used for applicable union workers instead of the standard state wage determination rates.

Federal only

 

The approved CBA rates are not applicable. Federal wage determination rates are used.

State and federal

 

The applicable CBA-based state requirement is compared with the federal requirement. The stricter requirement is used for the compliance check.

This article describes how to add a CBA to eComply and submit it to the agency for review.

 

Before You Begin

Ensure that the Collective Bargaining Agreement module is available in your system.

Steps

Create the CBA

  1. Sign in to eComply with your contractor user name and password.
  2. Select the Setup tab in the left navigation pane.
  3. Select Collective Bargaining Agreements.
  4. Select New Collective Bargaining Agreement.
  5. Enter a name for the Collective Bargaining Agreement.
  6. Enter an Effective Start Date and an Expiration End Date for the CBA.
  7. Select the Union Name from the drop-down box.  If you do not see the union name in the list, please contact support for assistance.
  8. Upload the CBA document into the system. The file type must be one of the following: .doc, .pdf. 
  9. Select all applicable Assigned Employees.
  10. If the CBA has holidays, select all applicable Holidays. Only those holidays that fall within the Effective Start Date and Expiration End Date for the CBA will be available.
  11. Enter the hourly rate and applicable fringe benefit amounts.
  12. Select Save as Draft to save the CBA without submitting it. It appears in the Draft tab and you can Edit it later.
  13. Select Submit to send it to the agency for review. It appears in the Pending Review tab. Once submitted, a CBA cannot be modified until it has been reviewed. 

    Note: You can filter by All, Pending Review, Approved, Rejected or Draft by selecting the appropriate tab.

Definitions

Field Description
CBA Name Identifies the Collective Bargaining Agreement in eComply.
Effective Start Date The date the CBA becomes effective.
Expiration End Date The date the CBA expires.
Union Name The union associated with the CBA. Select an available union from the drop-down list.
CBA Document The Collective Bargaining Agreement file uploaded to eComply.
Assigned Employees Employees to whom the CBA applies.
Holidays Holidays covered by the CBA. Only holidays within the CBA's effective and expiration dates are available for selection.
Hourly Rate The applicable hourly wage rate established by the CBA.
Fringe Benefits The applicable fringe benefit amounts established by the CBA.

Summary

To add a CBA in eComply, navigate to Setup > Collective Bargaining Agreements, create a new agreement, enter its dates and union information, upload the agreement, assign applicable employees and holidays, and enter the wage and fringe benefit rates. Save the CBA as a draft if additional changes are needed, or select Submit to send it to the agency for review.

Once approved, the CBA can be used for applicable state prevailing wage compliance checks. Federal requirements continue to apply independently, and when both state and federal requirements apply, eComply uses the stricter requirement.
